What proof is to say that fingerprints are not changed? Conditions under what this change is possible are given. I wish to share my personal experience here, a few years back I was suffering from eczema on my fingers. Due to that, blisters would develop on my fingers and the skin become thick. After some time the skin would peel out and new skin appear. On that new skin, there were no fingerprints! Recently a case was spotted in Pune; there an old man of about 80 years was rejected Adhar Card because he did not have fingerprints! Persons in following professions are likely losing fingerprints due to their work, blacksmiths, masons, pot makers (Kumbhar), home servants who clean utensils with brick powder and such abrasives, farmers etc. due to their demanding profession fingerprints are worn out and reappear and again wear out. Supposing the person has to go to give his identity while the fingerprints have worn out, Sir he/she will be denied identity!

All these defects we do not see in face identity. Moreover, there is no possibility that any international monster corporation is interested in them because they are not "linked" with their data cloud. Sir this linking need be studied to get to its roots. It is noticed that even if a person tries to hide his/her identity by facials, our brain computer can detect the face from out of that facial treatment. This unique nature's gift we should use for this purpose and not to indulge in this artificial method that need lot of equipments, up grading of these equipments and much more. We have many cases where police personnel have identified a person from under any facial treatment. Thanks to nature's computer Brain! We can train concerned personnel in this art of detection, which is common practice in police work. One recent inspection has shown that, instrument used to detect fingerprints out of them 35% are defective! Using our brain and with its sixth sense intuition to detect a fraud is more reliable than this mess of electronic gadgetry. This also needs a lot of foreign exchange, which is short with us.

Sir, I have completed my easy and hope that this vital effort will help you get to the nerve of this business of selling identities of Indians to USA corporations. I hope your honorable self has understood the fallibility of this high-tech method.

To compare conventional photo method to identify a person and this complicated method we observe that this method can make an individual incompetent in living because he/she will be denied his identity due to faulty equipment and other involved factors. Under such eventuality, he/she as well as the intermediate agency (bank, government department, municipality etc.) that does the checking is not able to remedy it. Concerned person is totally divested for no fault of his/her. This is the most important defect in this seemingly perfect method. Whereas, in simple photo method things are very clear, right there the identity is proved without any hurdles. Let me point out to your honorable self that nature has provided one Super powerful computer called our brain, that can do the required identification of the person under study. There is no computer as perfect and as non-fallible as our brain. So far, we depended on this nature's gift for such tests. Moreover, it does not need any particular skill or equipment required to identify that person from the photo provided. However, I admit that the size of photo presently kept on Pan Cards is too small; at least Passport size is provided so that details of the features are clear. They should also use high-resolution camera to take that photo. These are not difficult things and with these small adjustments, we shall have a most infallible tool to identify the person. Government may have to; in place of Adhar Card issue new PanCards on same terms (free) to its citizens with bigger photo. That will replace the old Pan Card with small photo. That shall do the needful for identification however; we see government insists for this half-baked technique. The time has come to ask this government why it so vehemently demands to impose this biometric method and linking everywhere. Following questions arise and government has to explain the need for this high tech method. Why USA has not adopted it for its citizens? It adopts it for foreign nationals

In the list of countries, we see most are poor countries, why so. Nationals from these countries generally migrate to developed countries for jobs. Why USA insists to introduce this biometric to other countries?

Only an honest inquiry by authentic investigating agency such as CID or CBI or such can show how business of selling this personal data to foreign research labs interests many third world countries such as ours, in promoting this half baked technique. Since the method depends on comparison with many data stored in the database, such agencies often need more such data from other places. This is the reason why many foreign labs who do this test need buy data from other countries. USA needs Indian data to compare foreign entrants in USA. This had developed big business in selling personal data to foreign countries. We already know how personal information from Face Book and Google is sold. Similarly, this data is also sold. Nandan Nilakeni who introduced this method in India, is believed to have earned much money by selling Indian data to such USA labs. Therefore, this business angle must be ascertained before giving this half-baked method permission in our country. The claim that this data is preserved and not available to other countries cannot be proved under this information. India has to share it with other countries such as USA because our nationals are visiting that country. Other countries such as Arabic sheikhdom need our data to ascertain existence of Indians in that country. All this clearly show that this data of personal importance is shared with many countries. Under this situation, how government assures the people that this data is preserved and not given out? To put it straight, Sir, I may say with confidence our government is fooling us by giving that false promise. Therefore, Sir, I do not want your august office to be a part in this crime.

All discussion on usefulness of biometrics is based on certain presumptions taken for granted, and if any one of that fails, this method becomes a hurdle in life of an individual. I say this because this method depends on many intermediate types of equipment. Let me show the line of steps involved in the process of identifying the individual. To first take the data and then eventually process it on the computer at that place, and then send it to the server, provided internet facility is available. Then further process to compare at the computer software, then the data returned to the end from where the test is performed; most time the data is send through an internet web system. Failure of any one of these very high-tech system will refuse to identify the person as that. This will create untold problems for the person concerned. This is the reason why such a high-tech system should not be applied in under developed countries such as India. To compare this so called super specialty method with conventional photo identity, we see that in photo method no involvement of any intermediate steps. This makes the system foolproof and safe for individuals. Moreover, we notice that in many cases finger-vein design may change due to diseases such as skin diseases. Accidents, other causes can deform that design. We also notice that iris design also changes as person becomes older, also due to severe eye disease. Moreover, we do not have any conclusive evidence to say that no two persons have same iris and fingerprints. The algorithm used is not necessarily reliable. We are made to believe that all these so-called scientific methods are foolproof. However, there is no definite proof to accept that claim. Everything is based on many unproven presumptions based on algorithm. Therefore, first let us prove these presumptions and then accept it or not. I firmly believe this method is being promoted for the business involved in selling fingerprints and iris. In many countries, this method is used to detect foreigners and countries such as USA are storing biometric information of people all over the world that includes India, to compare it.

Nobody knows why he or she is collecting this information and who makes money in this business. Court should be educated about all these complicated subjects so that it shall take a perfect ruling and we shall be saved from the foreign powers. I say this because my findings indicate that there is big business in selling our data to multinational monster corporations. In short, I dare say this government is doing business of selling this personal data with help from persons such as Mr. Nandan Nilakeni who was with Congress and now with BJP. Mr. Nandan Nilakeni introduced this biometric technique in India at the time of Congress rule but it did not take speed then. Later on, BJP came in power and this businessman joined BJP, continued his salesmanship for this technique, and finally was successful. His involvement deserves to be considered and an enquiry into his involvement by CBI will yield such information that will prove interlink in this man, present politicians and international corporations who buy the data. My point here is that we should not allow any business of our personal information such as iris details and then fingerprints and after that, every other detail llinked with Adhar card such as driving license, bank account, property and many more those will be attached with this number. Personal information can be used by international criminals and many countries who want to do harm to our people. Even terrorist corporations financed by Arab countries are buying this data. The claim that our information is not sold out to outsiders will be untrue after this investigation. That is important because if such a thing happens, in future our Court will be party to that crime. That could be very shameful to all those who respect this august house. My intentions in this matter is that our courts are not coming in any trouble due to a wrong ruling in this matter of biometric technique.
Now Sir, I would like to share some information about the technical feasibility of this modern technique and its limitation. We shall see its history, why it is introduced, when we already have a unique identity test of facial specialties. We know from time immemorial that no two faces are alike. This principle is in use for all these years then; why this complicated identity test that needs complicated linking of many machines to get its results, is introduced. The question is, Sir, is there any need to have such a flawed method to replace more reliable and time proven method of identity by face reading is available. Interesting part of my observation is that, Sir; there seems no special facility in this new method worthy of appreciation. I wish that your honorable Judge should insist to know from promoters and admirers of this biometric identity test, what is so special in the identity marks that face does not have?

Following questions arise and government has to explain the need for this high tech method.
  • Why USA has not adopted it for its citizens?
  • What proof is to say that fingerprints are not changed? Conditions under what this change is possible are given. What guarantee that INTERNET service is without fail is always available everywhere in India?
  • What control Indian government that we as citizens of this country should trust?
  • In view of this and many more questions, I have written a plea to our Supreme Court. I wish to share it with my readers here,

Subject: vital information about biometric identity

Sir, I am a responsible citizen and I very much feel that it is the duty of every responsible citizen to help our judiciary system in delivering the most appropriate ruling. I have also observed in case of many subjects, the ruling of the Courts were wrong because the judges were not provided with appropriate information from any of the parties concerned or third party. We cannot expect these honorable people at the court to go on studying various topics those concern the matter before the Court.

In view of this belief, I began to collect information about this ultra modern technique for establishing identity of an individual. I very much feel that the information collected and given in this easy will definitely help your office in taking appropriate stand on this important topic that concerned the very identity of an individual. If this system is faulty, the results will destroy that person since his/her very identity is challenged by the country. He/she will not be able to operate his account, enter his house, and many varied activities. Therefore, Sir you will agree with me that the technique imposed on people of India by the existing government must be 101 percent perfect. No body will be denied him/her his/her identity because the technique is faulty. Denying identity amounts to killing that person while he/she is living. I understand that the responsibility of our Court to scrutinize every aspect of any system that is incorporated to establish identity is paramount.

There are other aspects also in this particular topic, which is about the business involved with this technique. After carefully studying the subject, following topics come up for observation.
  1. We should see what other countries have accepted this ultra high technique.
  2. Who introduced this technique in India?
  3. What contract agreement (court should go through those details) was signed to get this technique in our country?
  4. We should also find out how details of our citizens' personal information are shared under varied excuses and that by whom.
  5. Who gets this personal information?
  6. What they do with it?
I am trying to keep this essay as brief as possible since, I am fully aware that your time is important. However, to cover the subject completely whatever detailing is essential; I shall do my utmost to achieve.
The assurance by this government that the data is protected is doubtful after I came to know of answers to these questions. Not only that, at present almost everything concerning the person is being connected (linked) with this Adhars number, various excuses are provided to justify this but also what is the real matter after it? I very much feel that these things are important and if your office takes a wrong decision in this regards, we may lose our vital information to international corporations and that could be dangerous to our national identity. In addition to that, it is infringement of personal privacy rights.
